Because even though they don't know one another and never conspired before that point, it looks like they almost had unspoken communication in entrapping Arbery. If that is a felony, and it resulted in his death, even if accidental: felony murder. But I'm not totally convinced that constitutes a felony, especially given the full context of Arbery darting out of a building, in addition to previously been caught trespassing in a building where thousands of dollars of items were stolen (from a boat at the building), given they only need suspicion of him having committed a felony to citizens arrest. REMEMBER: the defendants are OWED reasonable doubt and a presumption of innocence. It is the states duty to prove guilt. You can clearly see it was Arbery's antics that set things in motion when you take the full context. Initially I thought the father and son had largely ended their pursuit and this random neighbour guy forced him back in their direction. If the above reenactment is correct, then that is not the way it played out. In addition the above reenactment makes mention but does not show the truck would have had to have gone in front of Arbery. If that is the case, it hardly seems like they can complain that Arbery was running to their truck. Even if malice murder for the son and felony murder were apt for the stranger, which I have a hard time believing, you've got to admit: Arbery had a role in this whole affair. Stop trespassing, looking around before you go in to make sure no one sees you and then dart out if you don't want to be suspected of wrongdoing. It is because of Arbery he is now dead and 3 men may spend the rest of their lives in prison (the prosecution didn't seek the death penalty). [/quote]
