Virginia Attorney General formally files lawsuit over health care reform

RICHMOND - Virginia’s attorney general has filed a lawsuit challenging the federal government’s health care overhaul law.

A spokesman for Attorney General Ken Cuccinelli said that the lawsuit was filed Tuesday in U.S. District Court immediately after President Barack Obama signed the landmark measure into law. Cuccinelli, a Republican, and other conservatives claim the law represents an unconstitutional overreach of federal authority.

Attorneys general from 13 states joined to file a similar lawsuit Tuesday in Florida. All but one —Louisiana’s —were Republicans.

Virginia’s lawsuit invokes a newly signed Virginia law that states that no state resident can be compelled to have health insurance, nor can they be forced to pay a fine or penalty for refusing health coverage.
