Judge: Chicago locks can stay open over Asian carp
December 2, 2010

CHICAGO — A federal judge has ruled against five states hoping to stop Asian Carp from invading the Great Lakes by closing Chicago-area shipping locks.

U.S. District Judge Robert Dow on Thursday said the locks will remain open. He says while potential harm from the invasive species could be great, plaintiffs did not present enough evidence that the harm was imminent.

States' Bid to Block Asian Carp Migration to Great Lakes Rejected by Court

Michigan, Minnesota, Wisconsin, Ohio and Pennsylvania sued in July, claiming that infiltration of the invasive species through waterways connecting the river and lake threatened the $7 billion sport fishing and tourism industry.

The suing states claimed that measures taken by the federal government and Illinois authorities, including creation of electrical barriers in the waterways, didn’t adequately address the threat posed by the fish.

They sought the closure of locks at the mouths of the Chicago and Calumet rivers, where they meet Lake Michigan, as well as installation of permanent screens, grates and other measures to stop the alleged migration. Chicago, the third-most populous U.S. city, abuts the southwestern edge of the lake.

Opposition to closure from the Army Corps and the reclamation district -- which is responsible for managing the 76-mile (122-kilometer) waterway network -- was joined by businesses that rely on those connections for commerce.

Asian carp bill passes, heads to White House

The U.S. House has passed a bill that could prevent Asian carp from entering the Great Lakes and Lake Erie, U.S. Rep. Steven C. LaTourette (R-Ohio 14) announced Dec. 2.

The Senate passed the bill Nov. 17. With House passage, it will be sent to the White House for the president’s signature.

LaTourette, who represents Twinsburg, was a supporter of legislation in the House to control the spread of Asian carp, and supported the Senate bill. The Asian Carp Prevention and Control Act was necessary, he said, because a live Asian carp was found June 22 on the Michigan side of the Army Corps of Engineer’s electric barrier in Chicago.

The bill makes it a crime to import Asian carp into the U.S., just as it’s a crime to import zebra mussels, another invasive species, LaTourette’s office explained.

Carp were found past the barriers a few miles from Lake Michigan, and were found spawning in the Wabash River in Illinois, not far from a connection to the Maumee River, which feeds into Lake Erie.

Congress Passes Levin’s Asian Carp Prevention and Control Act
S.1421 Sent to President Obama for Signature

“The U.S. Congress took an important step today in the effort to keep Asian carp out of the Great Lakes,” Levin said. “These fish pose a real, clear and growing threat to the Great Lakes and I will continue working with my colleagues to ensure tools like the Asian Carp Prevention and Control Act and others will be available as we counter this threat. The devastating effects Asian carp could have on the Great Lakes are not fully known, and I want to make sure they are never realized.”

The Asian Carp Prevention and Control Act would list the bighead carp as injurious wildlife under the Lacey Act, which was originally passed by Congress in 1900 and amended in 1981. Listing the bighead species of Asian carp under the Lacey Act would help prevent the intentional introduction of the species by prohibiting the interstate transportation or importation of live Asian carp without a permit. This legislation would not interfere with existing state regulations of Asian carp, and it would allow states to issue permits to transport or purchase live Asian carp for scientific, medical or educational purposes. The Fish and Wildlife Service has already listed other species of Asian carp as injurious under the Lacey Act.

Originally introduced into the United States as a management tool for aquaculture farms and sewage treatment facilities, Asian carp are voracious eaters that can grow up to six feet and 110 pounds. These non-native species were first used in Louisiana catfish farms in the 1970s to control snails and vegetation. In the mid 1990s, flooding allowed the Asian carp to escape from fish farms. They have spread to most of the Mississippi River watershed and the Missouri River, devastating the food resources and habitats of native and sport fish populations. The bighead carp, along with the other species of Asian carp, now account for the majority of fish in the Missouri River.

The Asian carp will die off once the zebra mussels take hold. Lake Erie is pretty cleaned up from them. The water so clear you can see the bottom in 25ft depth. Its very bad for the small mouth and walleye. they need stained water. Good for trout, muskie, northern pike
