This is rigged dude. Completely.

The apparent "X" is explainable and reasonably common. It's kind of an illusion created by light shining on and then through the iris of the eye. The camera turns the pixels immediately around the "shin" in the eye all black, and will also turn pixels on the bottom of the iris black due to contrast. I strongly think that's the factor at work here, since the outside of his irises are black as well--which indicates it as a bad contrasting alteration or poor imaging with the camera.

However, I did a close up, and it definitely looks like the first picture is brown eyes, the second blue.

Of course, contact lenses can do that, so it's hardly conclusive of anything.

sure looks like a perfect X shaped pupil

but for once I have to say I think the light reflected in the top center of the left pupil is what is making it appear to be X shaped. The lit up shiny area hides the pupil area in what appears to be the top V shape missing from the black area of that pupil.

good one tho, it sure does appear to be a perfect double reptillian eye slit.

but, strange blue with glasses on, and appear brown with glasses off, it could be his pupils are just wide open, because of dark/dim lighting during the mugshot?

Thank you Sandi, this seems to be a decent answer to the issue, strange as it is though,(not your post, the pic) I am sticking with the alien possibility. More doomish that way..lol
