A person can not be "charged" Federally without an "indictment" being handed down by a Grand Jury...

Loughner WAS being held in custody on a 'criminal complaint'...The feds had 30 days to indict...As I said before, the prosecutor may indeed bring more charges, and is in fact expected to seek indictment for the death of Gabe Zimmerman, as he was a Giffords aide who was also WORKING...The prosecutor may also attempt to get an indictment for the killing of Roll, and may well get one...However proving his case will be difficult if the law is actually read to the jury...

I'll add my own reasonably informed speculation to this laundry list of guesses offered on one blog:

It's also possible federal law enforcement and judicial employees were instructed to dismiss the murder charges, using any or all of the excuses listed above, but with the real reason to further remove the ASSASSINATION of judge Roll from public view so the only focus will be on Giffords and her "miraculous" recovery.

This also avoids "double jeopardy", allowing Arizona to administer a lethal injection for a murder conviction. This is perhaps the most crucial part.

I've come to the conclusion that judge Roll was one of the primary targets in the shooting, he was not simply an innocent bystander. This is just one example of evidence that suggests this. If Roll was one of the targets then the Loughner lone nut theory is in serious question. Why should Loughner wish to target a federal judge? Was he obsessed with the judge, as we're led to believe he was obsessed with Giffords? Why?
