That's what I've been trying to figure out on Girl Genius' thread. It's issued by the USDC, but the issuing officer is Taitz. So, does the order carry the weight of the District Court? Will there be contempt charges if Fuddy refuses to respond?

There's a game they can play, and eventually a judge will have to compel production if the state of Hawaii doesn't want to produce.

Hang on folks. A lawyer is saying this:

1. Subpoenas in a civil matter are issued by a party. This is something she generated 100% on her own. The only signature on that subpoena is Taitz. Not a judge.

2. Fuddy isn't "court ordered" to do anything. Again, it's Taitz issuing the subpoena, not the court.

3. Taitz made the address of the deposition Fuddy's office. Someone cannot appear, or bring records, to the address at which they are served a subpoena. This makes the subpoena in essence a nullity.

4. Fuddy and the DOH can ignore the subpoena. But, if they do file a motion to quash, it will absolutely most likely be granted.


Can we have another lawyer chime in and verify this. I don't see a judges signature or a ADA. I hope this subpoena can be enforced and how did Taitz get her hands on a DC Subpoena?

Yep. There'a always some legal bullshit reason we can't just see the real deal, and have some pros inspect it.

You don't need a judge to sign a subpoena. If they do not respond, Taitz can file a motion to compel. If the motion is granted, the judge signs an order compelling production. Not sure if they can appeal that decision.

I'll believe it when I see it. We've had way too many of these cases dismissed for standing for it to be that simple.

The title of the thread is quite clear to the content. It was your decision to click on it and participate. Why would you waste your time, if you are so convinced there is nothing of value here?

I don't allow myself to get too excited. I don't hold my breath. We have been burned too many times. So, I am just taking a watch and see position and hoping just a little.

Discovery powers are sweeping, assuming Taitz has filed a proper complaint, rules are rules.

How and why the defendants might get the case dismissed before discovery starts is the question.

Releasing the certified "copy" has opened some legal doors to seeing the original, I think.

But, the way the system works, and given that Obama has unlimited funds for lawyers, they could fight the subpoena for quite a while, and maybe quash it, but I doubt it.

Their only hope to avoid producing the original is to get the case thrown out.

She’s a lawyer prosecuting in her own behalf and as such is an officer of the court.

Federal Rules of Civil Procedure

Rule 45. Subpoena

(3) Issued by Whom.

The clerk must issue a subpoena, signed but otherwise in blank, to a party who requests it. That party must complete it before service. An attorney also may issue and sign a subpoena as an officer of:

(A) a court in which the attorney is authorized to practice; or

(B) a court for a district where a deposition is to be taken or production is to be made, if the attorney is authorized to practice in the court where the action is pending.

If the past three years are any guide, that's exactly what will happen. Check it out. This same judge dismissed one of Taitz' cases last year.

"This is one of several such suits filed by Ms. Taitz in her quixotic attempt to prove that President Obama is not a natural born citizen as required by [the] Constitution," Lamberth wrote in a decision published on Wednesday. "This Court is not willing to go tilting at windmills with her."

Lamberth wrote that only the U.S. attorney general or a U.S. Attorney's Office can ask a court to file a writ of quo warranto, which according to Black's Law Dictionary is a "common-law writ used to inquire the authority by which a public office is held."

Lamberth dismissed a slew of other counts in which Taitz alleged violations of the False Claims Act, the Freedom of Information Act, and the Racketeer Influenced and Corrupt Organizations Act. He also rejected her argument that the recently passed health care reform act was unconstitutional because, having failed to prove he was a natural born citizen, Obama did not have the authority to sign the bill into law. Lamberth pointed out that at the time she amended her complaint to include that claim, Obama had not actually signed the bill.
