You have a right to ask for a copy of your file at any given time. Any decent legal assistant could sit down with you and review your file (I used to with many clients). I'm guessing you have a typical contingency attorney and you have a standard 1/3 contract? Typical settlements are 3x the actual damages incurred by the injured party. As far as going above and beyond policy limits, it's complicated. Possible, but complicated, and depends on the rules of your county court (factor in possible/likely tort reform legislation in your state). If criminal charges are involved against the responsible party, that changes the game as well. Not enough information to go on, and I wouldn't even ballpark for you (ethics violation). Get cozy with your attorney. If he/she is inaccessible, you have every right to seek another attorney. Best of luck. You NEED to communicate with your attorney. Keep a daily journal, recording daily tasks that you can or cannot do (VERY important), whether it's taking out the garbage or having sex (you don't have to respond to any of this, just letting ya know). All of it, where it hurts, when it hurts which way you are twisting/moving, or if you can't at all (times of day important too). This all factors in. Please be open and honest about any life changes that have occurred since your accident, even if it seems minor. Keep any and all mileage to and from the attorney's office, doctor's offices and pharmacies. Prescription receipts (she should have already told you that by now). Parking/toll receipts as well. Document everything, no matter how insignificant you think things are. You misunderstood me about the tort reform, but that's okay. ;) We're not talking about malpractice, we're talking about personal injury. You sound like you're in very good hands. You should decide what you think it's worth and then find an attorney that agrees. If you don't do this you might be disappointed and it could be to late to fix. I had a case and had to go through 4 attorneys till I found one that got me what I wanted. It is the most important thing as some attorneys are hopeless and if they say your case is not worth much I would not even waste my time with them. |

Did the OP or the Defendant have political or otherwise offensive/divisive bumper stickers on their vehicles and did those stickers make it into the photos of the vehicle damage which might be introduced as evidence at a trial? I could think of about a hundred other questions such a this which will all factor in to what a jury might award which is the starting point where insurers determine what to pay. That being said though if there is no unusual factors present I would suggest that 3x past medicals plus 1.5x estimated future medicals would be a good guess. Its just a matter of how much coverage he has and I have. The kid family own a auto collision business.This I know because he kindly offered to fix my car for free.But I was injured.I could not function the next day.So I called a attorney.Not a goodd one.He dropped my case.which is good.He wanted 40 percent of the settlement.Then everything changes.The doctors began to believe me,Then came the surgery. Its a very young careless driver who admitted brake failure.weather or not that was true,I have no idea. If it goes to trail,and I think it wont,The insurance company may have to pay more then policy limits.I know medicare wants its money back because of the careless driving of the defendant. As I mentioned before my attorney is both a doctor and lawyer.If she is willing to go to trial,and she is.I am sure its a solid case.
