Yeah, they do this is California prisons. I was there when they first started in 2005 and they lined us up like cattle.
Weeks later, quite a few dudes were taken for crimes like murder and rape from these DNA samples.

DNA tests actually free many falsely convicted prisoners as well here in the U.S. and I suppose you are against this as well?

So I decided to check out what the Penal law for NY is, I didn't look in-depth but here are some things that look to be included:




Section 240.10 Unlawful assembly

A person is guilty of unlawful assembly when he assembles with four or more other persons for the purpose of engaging or preparing to engage with them in tumultuous and violent conduct likely to cause public alarm, or when, being present at an assembly which either has or develops such purpose, he remains there with intent to advance that purpose.

Unlawful assembly is a class B misdemeanor.


Could Occupy Wall Street or Tea Party events be construed as this?



Section 240.21 Disruption, or disturbance of religious service

A person is guilty of aggravated disorderly conduct, who makes unreasonable noise or disturbance while at a lawfully assembled religious service or within one hundred feet thereof, with intent to cause annoyance or alarm or recklessly creating a risk thereof.

Aggravated disorderly conduct is a class A misdemeanor.



Section 240.30 Aggravated harassment in the second degree.

A person is guilty of aggravated harassment in the second degree when, with intent to harass, annoy, threaten or alarm another person, he or she:

1. Either (a) communicates with a person, anonymously or otherwise by telephone, or by telegraph, mail or any other form of written communication, in a manner likely to cause annoyance or alarm; or (b) causes a communication to be initiated by mechanical or electronic means or otherwise, with a person, anonymously or otherwise, by telephone, or by telegraph, mail or any other form of written communication, in a manner likely to cause annoyance or alarm; or

2. Makes a telephone call, whether or not a conversation ensues, with no purpose of legitimate communication; or

3. Strikes, shoves, kicks, or otherwise subjects another person to physical contact, or attempts or threatens to do the same because of a belief or perception regarding such person's race, color, national origin, ancestry, gender, religion, religious practice, age, disability or sexual orientation, regardless of whether the belief or perception is correct; or

4. Commits the crime of harassment in the first degree and has previously been convicted of the crime of harassment in the first degree as defined by section 240.25 of this article within the preceding ten years.

Aggravated harassment in the second degree is a class A misdemeanor.



Section 250.10 Possession of eavesdropping devices

A person is guilty of possession of eavesdropping devices when, under circumstances evincing an intent to use or to permit the same to be used in violation of section 250.05, he possesses any instrument, device or equipment designed for, adapted to or commonly used in wiretapping or mechanical overhearing of a conversation.

Possession of eavesdropping devices is a class A misdemeanor.


So does this mean they'll take samples of everyone in the government who utilized or will utilize the Patriot Act in NY? lol



Section 255.17 Adultery

A person is guilty of adultery when he engages in sexual intercourse with another person at a time when he has a living spouse, or the other person has a living spouse.

Adultery is a class B misdemeanor.

Proposed DNA bank could ensnare NY graffiti artists

ALBANY, New York (Reuters) - Fortune-tellers beware: palm-reading could land you in New York state's criminal DNA database.

Convicted graffiti artists, subway turnstile-jumpers and anybody who writes a bad check could also end up with their genetic information permanently on file under a proposal by Governor Andrew Cuomo.

The Democrat on Wednesday proposed expanding the database, which was created in 1996 and collects DNA samples from people convicted of felonies and some serious misdemeanors. Cuomo wants it to include anyone convicted of a crime under the state's Penal Law.

If the measure passes, New York would have the most expansive DNA database in the country.

For years, supporters have said a larger DNA bank would help lock up criminals and exonerate innocent people.

"DNA is the state of the art, and it's a sword that cuts both ways," said Sen. Stephen Saland, a Republican who last year sponsored a bill to expand the database.

Like I said before , if the government has samples of an individuals dna or access to samples (and they do) dna is useless in the legitimate prosecution of criminals.

Let's say there was a serial rapist in a given neighborhood, or a man charged with molesting a kid and they wanted to pin it on a particular person.

Whats to stop them from getting a warrant, obtaining items with the accused persons dna on it, and cross contaminating the clothing of the victim with this dna? What's to stop them from using blood samples taken in medical tests for the same purpose?

NOTHING, that's what.

This is why DNA is useless to prove guilt or innocence, because it relies totally in the honesty of the people involved in the process.

I hear ya, but if you do no crime, then most people do not need to worry. If you do and you are worried, then don't do the crime if you cannot do the time and now, give your blood. You lose many rights when you commit crime and now it gets even more serious for criminals.

This already goes on in Colorado for Felony convictions (not lesser charges). I believe this has been done for quite a while, but again, ONLY for felony CONVICTIONS, not arrests. Now, depending on the situation, if you are being processed, and they do a blood sample or swab for other reasons, it's already too late (though it's not supposed be held on to and used for later purposes other than for the original charges...). May we live in interesting times... :)
