The high court split 5-4 on the decision to uphold the Florida Supreme Court's ruling throwing out evidence seized in the search of Joelis Jardines' Miami-area house. That search was based on an alert by Franky the drug dog from outside the closed front door. Justice Antonin Scalia said a person has the Fourth Amendment right to be free from the government's gaze inside their home and in the area surrounding it, which is called the curtilage. "The police cannot, without a warrant based on probable cause, hang around on the lawn or in the side garden, trawling for evidence and perhaps peering into the windows of the home," Justice Antonin Scalia said for the majority. "And the officers here had all four of their feet and all four of their companion's, planted firmly on that curtilage -- the front porch is the classic example of an area intimately associated with the life of the home." A package mailed in San Jose, Calif., to a home in Vermilion was intercepted Saturday at Cleveland Hopkins International Airport, where a police dog alerted officers to the smell of marijuana. Someone had a You Tube here about an airport security dog. Think it was Canada? Watching them, I wondered too. The dog looked like he was a "for show" dog, to make people think they were doing something. The handler looked the same. A good working K 9 and partner are tuned in to each other and you can see it. That dog and handler weren't. Doubt the dog was stupid, but seriously doubt that he or the handler were very well trained. |

Their nails are trimmed short to prevent excessive mauling; teeth are enough. I've witnessed dogs searching cars. They paw at seats if they smell something, then look over to the handler, who then cuts open the cushions. |

It doesn't take more than a couple molecules for a dog to pick up scent. Nothing is sealed well enough to keep a well trained dog from finding it. Even glass has tiny pores that allow scent thru.
