Published my Murder Mystery, using unsolved cases in CA... Walnut Creek Police Dept upset.
After researching an unsolved murder of an off duty San Francisco under-cover police officer back in 1988, I used it in my book.

Back in July 1988, an off-duty San Francisco Vice Police Officer was murdered in Walnut Creek. There were many different clues, but with all of them, one of the main suspects managed to escape to Florida. There after getting in trouble with the law and spending one year in jail, she was turned over to ICE. She was deported back to Scotland.

Not only did the Walnut Creek Police Dept not allow the San Francisco Police Department help with the case, they stated that they did not have enough evidence to issue a warrant for anyone. This case was even on John Walsh's 'Most Wanted'... but still it goes unsolved.

So, I incorporated it into my Murder Mystery of a Serial Killer in San Francisco. The fact that I brought up a lot of unmentioned leads that they seemed to want to ignore, they are not happy with me. They want me to pull my book... what should I do?

Wow... I was hoping that someone would have a suggestion to prove to the Walnut Creek police dept that they need to leave me alone.

So what if they "want" you to pull your book. That hasn't ever stopped countless other authors. Grow a spine. Be one of the few journalists left in this world. You're not breaking a law. Put your big boy pants on or find a different job.
No offense.

I wouldn't worry about it.

Now that would be an excellent idea. I think the reason they are pissed is because they allowed the one good suspect to be deported back to Scotland.

Is it this case?

[link to www.walnut-creek.org]

Please be more forthcoming with what they have communicated to you re: their being upset.

Dd they email, call, write?
was the communication from them or from attorney(ies) representing them?
Is your work fiction or non-fiction?
If fiction, then they don't have a leg to stand on.

What is your relationship to this crime or its participants, if any?
If this your first published work or are you an established author?
Are you self published, vanity published or e-published?

Thanks in advance for your response if any.

Yes this is it. In my story, I go into greater detail on how the two police departments could not see eye to eye. I went through some of the police union newspapers and other published items for the San Francisco police and found that certain officers that tried to point out certain things were demoted and ended up quitting.

I also mention that a few of the officers that were in charge of the investigation in Walnut Creek seemed to go out of their way to NOT investigate the murder. It was a mess. And since back in 1988 they did not have DNA testing and it was just starting to be used in crime investigation, the District Attorney would not allow the use until much later. By then, some of the evidence was degraded and they could not use it.

I'm not a lawyer but have dealt with the
legal system more than I cared to. My
guess is that the police dept itself
will do nothing. They won't have a
case against you and it will draw
attention.

Individual officers may try to sue you
for defamation. Just make sure you
have your facts straight and be
aware that you may have to
hire a lawyer.

I think it's quite unlikely that a jury
or judge would rule against you but
you may get hit with some legal costs.

I judge that quite unlikely,
especially as the case is so old.

A similar thing happened in Fresno, CA years ago. The son of a murdered nightclub owner grew up and became a journalist in L.A. He did his own investigation of his father's murder and wrote a book about it that made the Fresno PD look bad and corrupt so they got pretty mad. Guess what they did? They solved the crime!! The book is called IN MY FATHER'S NAME by Mark Arax. Pretty good read.

So perhaps the Walnut Creek PD will go to Scottland, get a confession and bring the killer to justice.
Hang in there!

I'm a bit confused. Scotland is not like Mali or someplace. We do have extradition. They could, with Interpol involved, arrange a trip to Scotland to interview, etc. With enough info they could have a warrant issued, etc.

That's the point. They have evidence, however, the Attorney General keeps saying that there is not enough evidence to extradite. She even spent a year in jail back in Florida for a drug conviction (because her husband would not push for an attempted murder conviction). Then when she got out, the authorities dropped her in the office of ICE and she was immediately deported.

This is why I started researching those who were suppose to investigate the murder.

Turns out that the police officer was part of an undercover vice sting in San Fran and took a couple of the surveillance tapes. Question was... who was on the tapes and why did they want them back so bad?

Should I get an attorney? Or just ignore the requests of the Police Department? I guess they figured that they can work with John Walsh's Most Wanted, because they controlled what was being released.
They can't control me.

Came home from out of state, to find an Investigator on my doorstep. He wanted to talk to me about my research and where I found my information. Of course I refused and he was not happy. Something about hindering an ongoing investigation. I laughed at him.

Let's see what their next step is going to be.
