Perhaps I am misunderstanding, but isn't the article stating the judge overruled a 25-year mandatory minimum and reduced it?

Every so often you read some ridiculous ass case where someone is given a life sentence for a minimal infraction. (This is NOT one of them, obviously, but I digress.) Even the judge speaks out and says its ridiculous. But the judge adds there was nothing he could do because he has no say in mandatory minimums - he HAS to hand down that sentence, period.

So is it just bullshit and a judge really can override a mandatory minimum if they're so inclined? Or did I misunderstand the nature of the 25 year sentence in this example?

In a rare legal maneuver, an Orange County Superior Court judge Friday deviated from a mandated 25-year-to-life sentence for a man who sexually assaulted a 3-year-old girl and sent him to prison for 10 years.

Kevin Jonas Rojano was convicted Dec. 3 of sodomizing a child younger than 10 and lewd or lascivious acts with a minor.

Rojano was playing video games in the garage of his home where he lived in Santa Ana June 4 of last year when a 3-year-old girl who he is related to wandered in to hang around, said Deputy District Attorney Whitney Bokosky. Rojano, who became sexually aroused by the child, pulled her pants down and assaulted her, Bokosky said.

Umm.....4in circumference would be a SMALL penis. I'm assuming you meant a large penis? 5 in. circumference is average, and 6+" circumference is large.

Basically this judge blamed the 3 year old! He basically said...the man was minding his own business, playing video games when the toddler wandered in to hang out. (a toddler can hang out??). Then says awww he didn't mean it. It wasn't his fault he got horny and shoved his dick up her tiny bottom and ripped her open. He stopped doing htat and had her jerk him off instead. Then when caught, he admitted it. So he doesn't need much time in jail. He didn't start it.

And if I'm not mistaken, Cali judges are elected so how about a recall from his district? I'll be watching this one if only to see how far down the sewer California has gone siince I left there over 20 years ago. Sick sick sick!
