If it was Ohio Revised Code, please look at your citation and give me the code number. There is probably a clause in it that specifies "or" reasonable control. In your wife's arms is certainly reasonable control. Not at all sure that citation would prevent further action. |

I reread the old thread, you were one of the main people who helped get this in to court. In the end none of it mattered but it opened the door. Here is the thing on that thread I only admitted once quietly. I knew my own dog bit me in the face. But I was temped to claim it to get the dogs destroyed. SO here is what happened. Dogs tear the little guy out of my wife's arms and toss him in to the pack to kill him. The wife becomes 20 feet tall and backs the dogs off, one goes in the house, the drunk lady tried to get close and grab another, pack freaks dog comes back out of the house and all and they goes back to attack again. The wife by presence alone backs them to their front door. I don't have words to express it, she owned 200Sqft with will alone and you could feel it. once she had control I pick the little guy up, he was out. He gets me good in the face. Not his fault. I later told the slosh neighbor I was claiming it was her dog that bit me, but I never claimed it on the police report, I never lied about a thing to the officers or court. But she was convinced I lied. I made the her spiral out of control on this notion. Here is where it gets good, their planned defiance was now shot. Before trial the prosecutor does not have to show their cards. There was no discovery yet. They had no clue the other neighbors wrote a letter even, about already filing complaints on the dogs. They were in the dark, this is why they wanted the trial till all three dogs were on the line for their lives. Their defense was that she let them out to defend her property from a burglar or a squirrel (can't make this BS up, true quote) So if one of us would have been bit, her defiance would have been valid. The issue was it happened in the neighbors front yard so we obviously lost control for a time. We were committing a trespass, this is why if I would have claimed a bite I was guilty. Especially since there was a case against the dogs and the insurance company will ask that. I knew someone who had to get that insurance and it was over 800.00 per dog. I can't remember if that was per year or per month. Her insurance was high due to the previous problems with her dogs. They were high risk for the insurance company. I live in a neighborhood where pitts and other dogs run free, the people who do care are about to get a tax on neutered and spayed animals. Can you believe it? 10 bucks a year for every neutered critter. I have friends who have saved many cats and dogs and they are getting taxed whereas the folks who let their animals roam free are free of the tax. So glad you won, and so sorry this happened to you.
