Even more disconcerting, there was sufficient evidence, the District Court recognized, to support Robbins’ allegation that BLM employees filed false criminal charges against him, claiming that he forcibly interfered with a federal officer. Federal prosecutors took up the cause, but Robbins was acquitted by a jury in less than 30 minutes.[Footnote 1] A news account reported that the jurors “were appalled at the actions of the government,” one of them commenting that “Robbins could not have been railroaded any worse … if he worked for Union Pacific.” Id., at 852.

The Court has held that the Government may not unnecessarily penalize the exercise of constitutional rights. S., at 82–84, the right to trial by a jury, Jackson, 390 U. S., at 581–583, and the right to travel, Memorial Hospital v. Maricopa County, 415 U. S. 250, 254–262 (1974). The principle should apply here too. The constitutional guarantee of just compensation would be worthless if federal agents were permitted to harass and punish landowners who refuse to give up property without it. The Fifth Amendment, therefore, must be read to forbid government action calculated to acquire private property coercively and cost-free, and measures taken in retaliation for the owner’s resistance to uncompensated taking. Viewing the facts in the light most favorable to Robbins, BLM agents plainly violated his Fifth Amendment right to be free of such coercion.

Thirty-six years ago, the Court created the Bivens remedy. In doing so, it assured that federal officials would be subject to the same constraints as state officials in dealing with the fundamental rights of the people who dwell in this land. Today, the Court decides that elaboration of Bivens to cover Robbins’ case should be left to Congress. Ante, at 23. But see supra, at 14, n. 6. The Bivens analog to §1983, however, is hardly an obscure part of the Court’s jurisprudence. If Congress wishes to codify and further define the Bivens remedy, it may do so at anytime. Unless and until Congress acts, however, the Court should not shy away from the effort to ensure that bedrock constitutional rights do not become “merely precatory.” Passman, 442 U. S., at 242.

I believe I actually met lavoy many years ago in N Dakota at an in-laws. That being said. I still think it was probably a hit.

I want to see the fingerprints on the gun. I want to see the fingerprints on the bullets. I want to see the fingerprints on the magazine. If he put it on himself he would have loaded it himself. He was a legal carrier. His prints should be all over it if it was his. I want to know who owned the gun. Was it in his name? Where did it originate? Was it a stolen gun? Why would he have a gun that wasn't his? It was planted after they murdered him. I want to know the guns history. I guarantee you it is a gun from a prior crime. Probably new York or DC. I want answers to these questions. And so should you.

I might have to catch it later I was just catching up and speculating to myself part of the reason might be whatever they did as they huddled around his dying body and then them obviously flipping him off. lavoy was murdered shot in the back and if I am not mistaken in the places called out in an early video of the shooting you know the one where they slowed it down...shot one shot two I think it might come close to lining up with the first three shots. but I haven't looked into it but one lower side of back..they said it was last but maybe first idk I am still taking it all in.
