OSP wasn’t the only agency called into question. The group of Arizona legislators are also demanding accountability of the FBI’s actions, including an apparent cover-up of critical components of the incident investigation: Also on the list of recipients were the governors of Arizona, Nevada, and Oregon. The letter calls into question the inconsistencies as it relates to civil rights lawsuits, where the state governments have files numerous civil rights complaints in the past, often supporting “known criminals” and many of those lawsuits target law enforcement officials, as well as state and local governments. Meanwhile, no civil rights complaints have been filed on behalf of Lavoy Finicum, where he was shot when there was no gun in his hand, nor was a gun even visually identified when the Oregon police shot him. My senators keep saying that they can't get involved in an active investigation. I don't see how they can refuse to investigate the many reports from Oregon of civil liberty violations that occurred under the color of law, especially LaVoy Finicum's death. |

Defense attorneys for the group argued that several of the counts against the occupiers should be thrown out ahead of the Sept. 7 trial. Like during previous hearings, many of the defendants bowed their heads and recited the Lord’s Prayer aloud before court went into session. Some members of the public seated in the courtroom joined the recitation. Defendant Jon Ritzheimer wore a tie with the image of LaVoy Finicum printed on it. Finicum, an Arizona rancher who operated as a spokesman for the occupation, was shot and killed by law enforcement Jan. 26 when he fled a traffic stop outside Burns, Ore. Attorney Amy Baggio, who is representing Joseph O’Shaughnessy in the case, said the only charge levied against all of the occupiers — conspiracy to impede federal employees — is unconstitutional. Baggio said the charge is too broad and allows the government to decide when a government employee is being impeded. She said the charge places a “sphere of protection” around government workers, which Baggio argued has the potential to create a chilling effect on political protests at government offices, thus violating the First Amendment rights of protesters. Given the jury instructions in an excessive use of force case against the government, the factors favor Finicum, not the government. Notably, the government knew they would have to prove their killing of Finicum, but according to FBI, there is no other surveillance that recorded what happened. The only surveillance that supposedly exists is the released video (and another one that was a lesser quality, which they have not released). This is bizarre. I have handled many hundreds of criminal cases and know that police are almost always equipped with surveillance on their persons and vehicles during even ordinary and mundane course of business. Yet, during this planned operation with state police and FBI, there is conveniently and strangely no other surveillance. Of course, not having any surveillance on the ground will put the government in a position at trial to have police testify about what happened, instead of the jury being able to see and consider much more objective evidence. Not only does the video that was released demonstrate police’ excessive use of force, but also the intentional plan not to properly surveil the incident creates a bad smell concerning the governments’ actions against Finicum. Love that state.. I am an Oregonian and extremely sickened by what happened. Sickened by a governor who ordered the siege be brought to an immediate end. She ordered all the media to be removed from the refuge.. the afternoon of Finnicums death. She is putrid human being. Bisexual has husband and a girl friend. The real liberal stellar piece of trash who is only in the office of governor because the actual governor had to resign for fraud etc etc etc.. The day after LaVoy was shot the media attempted to meet with the governor but she was having TEA and could not be bothered.. From that moment on I swore I would help kick her lilly white arse out of office come fall! |
