Those were my thoughts too. He's gonna pull some major shit the last days. Stuff that will create immediate controversy for Trump.

1) Release KSM to a Muslim country (possibly all prisoners.)

3) Clemency for Hillary

President does NOT have power of "clemency." That is for state governors.

President has power to "grant reprieves and pardons."

Reprieves are a lessening of a sentence. Pardons are overturning a sentence.

President has ZERO power to interfere in a sentence before it is given.

Doesn't mean he won't try, but Trump can, well ... TRUMP him. Only question is if he will.

What Ford did had NO legal authority.

However, it was never challenged and Nixon was never prosecuted because BOTH parties had a lot to lose.

Republicans were in disgrace because of Nixon, and Democrats had papers related to the real killers of JFK, which is what the Watergate burgers were after.

Lots of secrets, so both sides played dumb. Ford's action had no authority, but it went unchallenged because both sides wanted it that way.

It is NOT a precedent, because the President has ZERO constitutional authority to pardon someone BEFORE any charges are even filed.

A "reprieve" is to reduce a sentence (as in, let someone out of prison for time served, like Manning).

A "pardon" is a wiping of the record completely, as if the conviction never happened (as in, what Clinton did for Marc Rich, in exchange for massive money donation to the Clinton Foundation -- a bribe).

BOTH of these are AFTER someone is convicted. The WHOLE POINT is to right a wrong that the courts did. It is a last-ditch attempt at justice, even though it is not used like that much, if at all.

President has ZERO power to pardon someone BEFORE the courts have their say. It was not challenged with Ford because both sides wanted to sweep it all under the rug. Also, note that Ford/Nixon is the ONLY example of this in history.

MASSIVE mistake to ignore it (and for the people to allow to be ignored), because it lead to the insiders thinking they could get away with anything, which has brought us to the clusterfuck we have today.

Time to restore constitutional authority. Let's hope Trump does that.

It is similar to Lincoln's Emancipation Proclamation. The EP did not free a SINGLE slave because (a) the President does not have that authority, and (b) the southern states were a separate country (the EP was not written until 1863, well after war was underway), and (c) the blacks in the north were already free. But nobody challenged it in court, so people pretend it had meaning. Historians love to write about power. They seem to be blood thirsty that way.

Symbolic meaning, yes. Legal meaning, no.
