I would say Martial Law would be needed to "engage" Military Intelligence as suggested, who would then supercede those agencies. DHS and all the agencies might be gunned up to fight other military level combatants. and then the US Marines and NG can go to direct war with the CIA. That's what I feel is the essence of the implication. Until Martial Law the agencies are protected by the way the world works.
