I am going to let you in on a smart move to make BEFORE the AWB of 2018 is passed, or if it is passed do it before it goes into effect.

Form a FIREARMS TRUST -- you can find the boilerplates to do this online.

Form a FIREARMS TRUST for each weapon you own. DO NOT PUT MORE THAN ONE WEAPON INTO EACH TRUST

So for example, if you own an AR-15 and a Glock 27 and a Springfield 308 do this:

Let's say you want to call your trust THE AMERICAN LIBERTY TRUST
then:

1) Form THE AMERICAN LIBERTY TRUST ONE FIREARMS TRUST and assign ownership of the AR-15 into it and be sure to note the serial number in the trust documents.

2) Form THE AMERICAN LIBERTY TRUST TWO FIREARMS TRUST and assign ownership of the Glock 27 into it and be sure to note the serial number in the trust documents.

3) Form THE AMERICAN LIBERTY TRUST THREE FIREARMS TRUST and assign ownership of the Springfield 308 into it and be sure to note the serial number in the trust documents.

A trust can be formed by signing your trust documents and signed by a notary - trust documents do not have to be filed into the public record (at least in Florida).

What does this accomplish?

The TRUST owns the firearms. You are a TRUSTEE of the Trust. In the future, if you want to assign a NEW trustee to the trust that is your business. The ownership is never transferred but control of the trust is and therefore, no sale.

This is a trick used with properties as well.

Every Class 3 item I own (like Silencers) have always been in their own Firearms trust -- I am not going to do it with every firearm I own.

The trust allows you to transfer a firearm without having to "sell/give" the firearm, which could one day be illegal.

possession of grandfathered arms is not on the table to be taken away, no one is taking away the guns already purchased, through an FFL or private no paper trail purchase.

The trust just proves the trust owned it before the ban and allows you to transfer after they ban transfers.

Go to any gun shop that sells class 3 stuff and talk to them, they should have knowledge of setting up trusts, if they don't, move on to the next one. hf

I assume you mean an event AFTER the trust has been formed.


Here is what I am saying.

I own a Springfield 308 personally now. So I create a trust and assign ownership into that trust. I now have a trust that I control as trustee that owns a firearm.

DONE.


Later you come along and I want you to have the trust. I AMEND the trust to list YOU as a trustee and I then RESIGN as a trustee at the same time.

YOU now are the only trustee of the trust and it still owns the firearm. It was not transferred from the trust to anyone else YOU TOOK CONTROL OF THE TRUST and the trust still owns the firearm.

You can prevent having to do deed transfers on properties and such in the exact same way if you place REAL PROPERTY (land or house or commercial building) into a TRUST.

I suggest that anyone considering this that doesn't have a solid enough grasp on trust to seek out someone that does (especially someone that understands a firearms trust) and have them spend the time to explain it to you.

It is involved enough that I can not be expected to provide a primer on trust law here on GLP and like I ais I just wanted to get everyone THINKING about creative ways to not get hung up in the horrible bill if it passes and becomes a law.

If the gun had to be sold through an FFL (as the law stands today). and it was purchased without going through an FFL, then wouldn't the purchase be illegal?

Meaning as of today, someone could own a gun they purchased illegally to begin with. and someone could put it in six trust if they wish, but they still purchased it wrongly.

I think found a hole...

You're saying that it's a way to buy and sell trusts (guns) without technically buying guns. Understood.

But if I buy your trust then the gun is in my posession. The law says that every owner must register the gun. If it's a banned gun then I can't register it which means as a new owner of a previously banned gun I could face penalties. Unless a trust can register a gun, but then only the trust can use the gun.

If you're using the gun then it must be registered to you. Or am I wrong about that last line?

I understand what you're saying, If it were illegal to buy or sell the item then your buying it through a proxy. But if it's illegal to HAVE then it doesn't matter how you get it. And if it's illegal to use then it doesn't matter who owns it.

I am going to let you in on a smart move to make BEFORE the AWB of 2018 is passed, or if it is passed do it before it goes into effect.

Form a FIREARMS TRUST -- you can find the boilerplates to do this online.

Form a FIREARMS TRUST for each weapon you own. DO NOT PUT MORE THAN ONE WEAPON INTO EACH TRUST

So for example, if you own an AR-15 and a Glock 27 and a Springfield 308 do this:

Let's say you want to call your trust THE AMERICAN LIBERTY TRUST
then:

1) Form THE AMERICAN LIBERTY TRUST ONE FIREARMS TRUST and assign ownership of the AR-15 into it and be sure to note the serial number in the trust documents.

2) Form THE AMERICAN LIBERTY TRUST TWO FIREARMS TRUST and assign ownership of the Glock 27 into it and be sure to note the serial number in the trust documents.

3) Form THE AMERICAN LIBERTY TRUST THREE FIREARMS TRUST and assign ownership of the Springfield 308 into it and be sure to note the serial number in the trust documents.

A trust can be formed by signing your trust documents and signed by a notary - trust documents do not have to be filed into the public record (at least in Florida).

What does this accomplish?

The TRUST owns the firearms. You are a TRUSTEE of the Trust. In the future, if you want to assign a NEW trustee to the trust that is your business. The ownership is never transferred but control of the trust is and therefore, no sale.

This is a trick used with properties as well.

Every Class 3 item I own (like Silencers) have always been in their own Firearms trust -- I am not going to do it with every firearm I own.

End result: I will be able to sell my trusts in the future and not violate this stupid law.

You will have a trust, formed, dated and notarized BEFORE the law took effect that names the firearm and bears the serial number identification on it. This not only will allow you to effectively transfer it later (family or not) but it also proves you had possession PRIOR to the law because you noted the serial number.

IF such a ban occurred, you might see it written in that NO sale is legal, either through or not through a “trust.”
But I highly doubt a ban will occur, because public backlash against a Constitutional crisis just isn’t worth the trouble for the politicians.
Also, if a ban ever was passed, most people would not desire to “sell” their guns. In fact, you’d see a mass case of “stolen” and “lost” reports, everywhere.

I’ve done something similar with an LLC (Limited Liability Company) to protect attachable assets. I am the Managing Member of the LLC. I can either sell the LLC to someone else, or I can name another Managing Member. This transfers control of the LLC’s assets, but the asset itself remains under the ownership of the LLC.

I am an attorney in Florida and what the OP has proposed is absolutely correct. As long as there is not a total ban that includes possession, which the current form allows those currently in possession to retain possession, this has a solid long established basis in law. A trust is in fact its own entity and you do not own the trust but act as an administrator through trusteeship.

Do your due diligence and you will see that the information posted outlines one avenue (LLC and Corporations are another but would have annual maintenance costs) to pursue to protect your firearm assets and maintain a pathway to transfer.
