Okay, this all comes down to Common Law (the last few posts) and in the US which is kind of the focus right now , something happened in 1871. The Constitution switched and the Bill of Rights (both based on Common Law, but he Bill of Rights more so) went 'poof'. If you want to dig into Common Law, be my guest.
