Quick insurance question
On my auto insurance online acct dashboard I went into the claims area and saw they had a roadside assistance claim that I never used.

They claimed it was for a tow. They found out it was false then they said they couldn't take it off of there but would send me a letter in the mail stating it was not a claim but a mistake. Ok, fine, the problem is...other insurance companies see a claim against me and partially base the premium on this derogatory checkmark so to speak, right? I told the supervisor that I was aware this causes a negative impact and that's why she is sending me a letter--to show potential insurers. Btw, how do you show a letter to an online quote? I shouldn't have to show anyone anything because of these assholes or prove I did or didn't do anything.

WHAT the living fuck? I told her that someone put it there, and they can (I demanded it removed) remove it, she said it was impossible to do so. Really, am I that dumb?

They want the others to see it although they know it's a mistake, but the rest don't know it's an error and increase their quote because of it and then they want me to decide to go with them because it would be cheaper, get it?

Is this even legal?

Re: Quick insurance question
Tell them you are contacting the banking and insurance department and filing a complaint. Insurance companies HATE having complaints filed against them. Then do it!

DO get a letter from them showing claim is an error. You should be able to fax a copy to the new insurer.

Yeah, I told them I was going to file a consumer complaint and I just don't feel I should have to prove anything because I didn't do anything in the first place. It makes it hard to shop for a good quote online. I told them to get bent on that letter because it felt to me like I was giving them an ok to just leave the claim on there, I want it off period. I am going to supposedly get a call back from the supervisor's supervisor within 24-48 business hrs. Thanks for the input.

Defamation of character occurs when someone makes a false statement about you that causes you some type of harm. The statement must be published (meaning some third party must have heard it), false, and it must result in harm, usually to the reputation.

I was an agent for 25 years, I know it sucks. Get the letter, it’s more documentation. You will need it if this company is that sloppy.

Re: Quick insurance question
Complaint goes to Deparment of Banking and Insurance in YOUR state. Filing a consumer report doesn’t do anything.

Right, that's along the same lines I was thinking, bastards. I can't get an accurate quote because of these bastards claiming I have a claim...defecating on my character.

It was them telling me it's time to re-up that led me to the discovery. I wanted a better price so I looked.

Thanks for all your help and idea's people.

You really need to file it in your state at the Banking and insurance deparment. Each state rules their own insurance. If one company is consistently doing illegal things they yank their ability to do business in your state....PLUS your issue will get settled. The commissioners group is not going to give a crap over your fake comp claim.

I would ask a few more questions. I am not so sure that a roadside assistance would count as an actual claim. That is usually something that is included with your policy. Towing, unlocking the doors. Personally, I have used both in the past without any negative repercussions.

He said it’s listed as a claim, but you are right it shouldn’t. Each state is different and I’ve been out of insurance for awhile. When I left, if you called in a claim and it was under the deductible..it still counted as a claim. I guess I wouldn’t be surprised if they are using towing against you now. Insurance companies are number crunching thieves. I used to love it when I first started. I co-owned an agency here where I live, then it was no fun...lol..I got out.

Each state has an Attorney General office. Contact them about insurance fraud, this is what this is. Then each state has an Insurance Commissioner, contact them about having an investigation on whether they are fit to practice in your state.

correct. roadside assistance is a throwaway...doesn't cost insurance company squat. That's why they don't want to bother.
