Fox News legal analyst Andrew Napolitano explained to Fox News host Dana Perino how Trump could be breaking the law with his new appointee.

Napolitano explained that Whitaker was not confirmed by the Senate and therefore violates the law.

“Under the law, the person running the Department of Justice must have been approved by the United States Senate for some previous position. Even on an interim post,” Napolitano said.

Napolitano continued saying that next in line for the position is Deputy Attorney General Rod Rosenstein.

I'll disagree with judge Nappy. An interim position is just that! Nobody needs approval to pull up the slack created by a vacancy. If Trump would have not named him interim and Whitaker simply does the job on an interim basis, then there still is no AG. The AG must be approved but anybody can run it unofficially.

(a) In case of a vacancy in the office of Attorney General, or of his absence or disability, the Deputy Attorney General may exercise all the duties of that office, and for the purpose of section 3345 of title 5 the Deputy Attorney General is the first assistant to the Attorney General.

(b) When by reason of absence, disability, or vacancy in office, neither the Attorney General nor the Deputy Attorney General is available to exercise the duties of the office of Attorney General, the Associate Attorney General shall act as Attorney General. The Attorney General may designate the Solicitor General and the Assistant Attorneys General, in further order of succession, to act as Attorney General.
