Quoting: Anonymous Coward 71433052 The Fourth Amendment generally requires police to obtain a warrant for a blood draw. But in a 5-4 vote on Thursday, the court upheld a Wisconsin law that says people driving on a public road have impliedly consented to having their blood drawn if police suspect them of driving under the influence. It also said that "exigent circumstances" permit police to obtain a blood sample without a warrant. Justices Samuel Alito, Clarence Thomas, Stephen Breyer and Brett Kavanaugh joined Chief Justice John Roberts in the majority vote. [link to www.npr.org (secure)] I say taze the unconscious in the genitals first, if they don't wake up, they are really unconscious so order the blood. If they do wake up, no blood needed, they can blow in a breathalyzer, or refuse, no blood needed. Problem solved. |

No harm, no foul right? You have to change it to expressed consent meaning put stickers on your vehicle or yourself that says warrant required for search as your rights are reserved. Why? You have the right to travel within the union without harassment regardless the mode of transportation since you have paid taxes for the very road you are driving upon. What is next, mandatory vaccination or RFID GPS implantation on unconscious suspects too because of implied consent? Don't smirk, with today's political climate, sarcasm may become reality. |
