The Legislative cant tell Judicial what to DO!!!   Quoting: Coastie Patriot Who makes the laws that the supreme court has to uphold? That's right, congress. The Supreme Court doesn't uphold laws it decides if laws are permitted according to the constitution. It actually just comes down to the popular opinion of the day. When the first law was passed creating a minimum wage it was struck down as un constitutional by the SCOTUS. What the dems want is for the court to stop doing that so that the constitution can be side stepped.
