Yes, they truly are ridiculous but I think many contain covert messages. Same with the list of threads on the index pages. One pattern I notice is words left out of titles. Happens a lot. And other telling things.

Flynn pleaded guilty in 2017 to lying to investigators about conversations with Russian Ambassador Sergey Kislyak. The defense team who negotiated the plea deal was fired earlier this year, and since taking over the new team Powell has argued “there never would’ve been a plea to begin with” if Flynn knew how much information the DOJ was hiding from him, alleging prosecutors improperly pressured Flynn into the deal.

The information allegedly contained in Mifsud's two Blackberry devices, Powell claims, is "material, exculpatory, and relevant to the defense" of Flynn and would shed light on “agents that western intelligence tasked against [Flynn] likely as early as 2014 to arrange — unbeknownst to him — ‘connections’ with certain Russians that they would then use against him in their false claims.” Powell also referred to the “oconus lures” — a phrase referring to spies outside the continental United States — which Powell told the Washington Examiner is related to a text message exchange between former FBI officials Peter Strzok and Lisa Page.

Folks, this case is about to break wide open.

The judge has stated several times that the production of Brady material takes priority (as it should) over the defendant’s plea agreement. Given that Powell has already argued that her client was set up and that the prosecution is withholding key evidence, the prosecution currently finds itself in a vice. There are 2 scenarios:

1) The prosecution can withhold the Mifsud phone data (which they probably did not realize the defense knew about), citing that it is not material nor relevant to Flynn’s case. However, Powell has already made the case as to its relevance and importance in the motion. So if they do this, it’s all over — it will become even more so apparent just how much evidence the government is still withholding, and at this point, the Judge would be seriously inclined to have the prosecution’s evidence audited to determine what exactly has been withheld.

2) On the other hand, if the prosecution produces said evidence (as they are required to do so by law), It becomes indisputable that Flynn was set up by the government via Mifsud, the “Maltese Connection.” The so called “conspiracy theory” accusation the prosecution has leveled towards the defense. Not a good look for the government.

In either scenario, this is a great development for the defense, for the court system, for the President, and for the people of the United States of America. Moreover, this is a critical point for the prosecution, as they are the side likely to be the side that is punished at this point.

Judge Sullivan will rule on this motion to compel on Halloween, 10/31.

Powell told Fox News on Wednesday that the Justice Department is currently in possession of Mifsud's phones.

When asked whether she thought federal prosecutors would comply with her request, she said: "I think the prosecutors in our case will look for them, but given their prior responses, I expect them to continue to say they are not relevant."

Powell has said that Flynn's case is “not ready for sentencing,” citing their timeline of receiving necessary files and documents that would be critical to the defense of her client. Powell also claimed in an earlier filing that the government “continues to deny our request for security clearances” needed to review classified material pertaining to Flynn, including transcripts and recordings of phone calls that “supposedly underpin the charges against” him.

The DOJ attorneys have argued, though, that Powell’s requests “seek access to classified information that may or may not exist.”

The timing of the Italy trip, Powell’s motion, and her assertion that the government only recently came into possession of Mifsud’s two smartphones, all suggest Barr and Durham returned stateside with the evidence—something a serious investigation into potential Russia collusion back in 2016 would have already looked at.

Federal prosecutors have not said no to providing Mifsud’s smartphone data, at least not yet. Instead, in response to Powell’s request for the data, the government told her that “if we determine that they contain information that is discoverable or that is relevant to sentencing, we will produce them to you.”

This response proves intriguing and triply so. First, the prosecutors speak of deciding, which suggests that they have not yet reviewed the smartphones. That raises an interesting possibility—that Barr and Durham are controlling the investigation of the investigators and they had yet to see the smartphones or data. Yet Powell knew about the phones, suggesting she has a well-placed source sympathetic to Flynn’s plight, or outraged by the political and prosecutorial abuse on display in this case, or both.

Finally, the government’s response indicates that federal prosecutors may be ignoring presiding Judge Emmet Sullivan’s standing order. In that standing order, Sullivan ordered the government to produce to “any evidence in its possession that is favorable to defendant and material either to defendant’s guilt or punishment.” But in its response to Powell, the government speaks of only providing evidence “relevant to sentencing,” and seemingly ignores the court’s directive, which was to provide any evidence favorable to Flynn and material to either his guilt or his punishment (sentence).
