If you file a report against someone, without pressing charges, are they notified?

The DA decides if they will be charged but without any witnesses, evidence or testimony it's unlikely they would charge them as they would not have much of a case.

But would the report be on the perpetrators file?

There are some things you can't avoid charges onafter a report, eg domestic violence.

Depends on what kind of reported event--was it serious, or criminal? If a serious or criminal charge is alleged, the alleged victim can also be charged with a crime if the allegation is clearly untrue--i.e. "filing a false police report."

if somebody reports assault and the officer doesn't arrest them, they are in jeopardy of being fired.


Cop has to make an arrest.

It's one sided,cops don't press charges on cops,thus all law is invalidated under the 14 amendment of equal protection under the law.if one crime is protected then all crime is protected.

Someone once wrote up a report about my dog that was entirely not true and I never got any notice or anything, I can't remember how I found out but it was by surprise i found out and i was shocked and it was way late to rebuttle or anything! It became a very difficult process to counter the report, so I can tell you i think this is a very unfair system when someone can file a report against someone and one never knows I guess unless they all add up or something

Also, as already said, rape is a crime. He should be arrested. If you were non compliant, it’s rape or can be defined as other levels of sexual assault as deemed by your state.

as for filing a report,that all depends upon YOUR local kop shop as some refuse to even take a report.

You have to report it. He may already have a record. He will do it again and has probably done it before. You owe it to other women to report him. If nothing else it will be on his record and if he tries it again they will have more to use against him.

I am so sorry for you. Let us know how it goes when you go in tomorrow to report the crime. You need to do it and call the rape crisis line first so they can better advise you how to deal with the police and maybe go with you. He needs to be stopped before he hurts anyone else again. If he gets away with it, he will keep on doing it.
I will keep checking back to see if you want to talk tomorrow. It has happened to me too, and I did not report it either, I understand. Do not blame yourself.
