I read thru the decision and it boils down to a simple argument the federal law protects (PLCAA) gun manufacturers from being sued. But that law has an exception that allows them to be sued for wrongful marketing of a weapon. The sandy hook survivors are alleging that bushmaster marketed their rifle as a weapon suitable for criminal purposes. If the lawsuit is successful, it means gun manufacturers will need to be very careful how they market their product. It doesn't open the door wide for wrongful death lawsuits in any situation. I'm curious how well Remington fights for a change. They've benefited greatly from all the gun grabbing fear and sold guns like candy these past 10 years. Time they step up and fight, not just take our money and pay lip service to our rights. |
