About three weeks ago, the neighbor came over and requested that I trim one of the large branches, since it is over his fence line (about 30 ft up). I understood the request, and got quotes to get it taken care of. $650 was the best price, so I've started to save towards it. This included completely removing the oak tree and cleaning up a large part of my property. Quoting: SoberLife Today while I'm in the shower, they stopped by and spoke to my girlfriend. They handed her a copy of a check for $1,500 they wrote to a tree service to get all the overhanging branches removed. They told her to give it to me and make out a check to them for part of the payment. They also complained they presented the payment request to the opposite neighbor (who had branches hanging over, too) but refused to pay them any money. I never agreed to this. At least with the $650 option, I would have benefited. How would you handle the situation? According to the link you provided OP, it would seem that: you are responsible for any tree limbs or roots trespassing on the neighboring property I would ring the company that quote is from to check that it is a genuine quote and not something the neighbor made. I suggest you give them a copy of the quote you have and tell them that $500 is all you are willing to pay because you are a responsible home owner and had the issue under control. The neighbors bill is for all limbs! Tell them you don't have the money and are willing to set up an automatic payment for (you decide how much) until your $500? share and only your share is paid because your quote is for your whole yard. I wouldn't recommend taking the whole tree down just because one limb pissed off the neighbour. By law he's responsible for any branches hanging into his property. |

The adjoining property owner to such a nuisance, however, is privileged to trim back, at the adjoining owner's own expense, any encroaching tree roots or branches and other vegetation which has grown onto his property. Your wife has recently spoke to my girlfriend and requested that I trim the tree branches that are encroaching onto your property. I understand this request and have received estimates to clean up all of the overgrown plant life that is near your property line. You and I have never come to an agreement about splitting a bill that involved work on your property only. Imagine my surprise when my girlfriend handed me a copy of a hand drafted check (not even an invoice) while requesting that I pay you money for work that you hired a contractor for directly! Furthermore, the check was written out for “Five Hundred” but the numbers on the check show $1,500.00. So there's a discrepancy on the amount in question to begin with. I will not pay your bill. I will however, move forward to hire a contractor to complete the work I mentioned above. This work will be done sometime after the holidays. I have also attached an article written by a Southwest Florida attorney in regards to this matter along with a supporting case reference.
