Federal law comes into play on federal territory or when between two persons of different states. There are for instance federal traffic tickets for federal roads like the Blue Ridge Parkway. I have trouble imaging how this law could apply in regards to having two people from different states. Animal cruelty is most often, I would think, a solitary act. That said, production of video and transmission of it could be a federal issue. And a conspiracy that spans state lines would be a federal issue. Nonetheless, somehow we’ve gotten by for over two hundred years without such a law.

(d) Exceptions.—

(B) the slaughter of animals for food;

(C) hunting, trapping, fishing, a sporting activity not otherwise prohibited by Federal law, predator control, or pest control;

(D) medical or scientific research;

(E) necessary to protect the life or property of a person; or

(F) performed as part of euthanizing an animal.

"cruelty" can be very subjective. If you swat your dog with a newspaper for pissing in the floor, will you be arrested? If you don't change the kitty litter every day, will you be arrested?
