Neither constitution means diddly. Ever see the phrase "compelling, or maybe overriding state interest" or whatever it is? That means "this is too important to us to abide by the constitution".
It's supposed to be simple, and it is, but they wangle it.
Wickard v. Filburn- an item not in commerce affects commerce and can be regulated under the commerce clause.
Obamacare - congress can tax any activity. The absence of activity ( not having health insurance) is an activity.
