Iowa Man gets 15 years for burning LGBTQ Flag

Adolfo Martinez, 30, of Ames, was sentenced Wednesday to 15 years for the hate crime of arson and given a year for reckless use of explosives or fire and 30 days for harassment. The sentences are to be served consecutively, Story County court records said.

This will be thrown out. Flag burning is free speech. Already ruled.

There is a difference between burning a flag that is the possession of another on another's property and burning a flag that one is in sole possession of on one's own private or public property.

There were no explosives. This was not a violent crime.

He removed a flag at a church and burned it in protest.

Had he lit the church on fire with people inside, the sentence would have been justified.

If you buy your own flag, you can burn it on your own property or elsewhere with permission, subject to local burn laws.

If you trespass and steal a flag from others, and burn it, you are guilty of criminal trespass and wanton destruction of others' property(vandalism). That much is easily understood by a normal elementary school student.

No doubt, this thing was claimed to be a "hate crime" too. That's more dubious and could account for the excessive sentence. Regardless, the perpetrator had unclean hands.

Whats the problem I burn LGBTQ Flags daily, they also work good as rags cleaning cleaning cars.

Agreed. The main problem here is that he trespassed and stole someone else's property, not that he burned a flag. If he wanted to make this statement, he should have bought his own rainbow flag and burned it.

That said, they really threw the book at this guy and most likely would not have applied the same treatment if it had been, say an Antifa stealing a POW flag off a VFW hall. Petty theft is not a crime deserving of 15 years, and burning a flag shouldn't really be considered arson unless he burned it indoors somewhere. Do we know where he set the flag on fire? My guess is adding the hate crime designation to it is what allowed them to get such an unusual sentence for otherwise minor crimes.
