FISA court looking at all of warrant applications from FBI lawyer involved in Carter Page wiretap

The FISA court confirmed Clinesmith had been referred to the Justide Department for a possible criminal investigation.

Judge Rosemary Collyer, who leads the FISA court, ordered the DOJ to bring it up to speed on everything it had learned about Clinesmith’s conduct and to explain why there was a delay between the conclusion of Inspector General Michael Horowitz’s investigation and the court being told what misconduct had been unearthed.

Specifically, the FISA court ordered the DOJ to “identify all other matters currently or previously before this court that involved the participation” of Clinesmith.

The court also ordered the DOJ to “describe any steps taken or to be taken by the Department of Justice or FBI to verify that the United States's submissions in those matters completely and fully described the material facts and circumstances,” unlike the Page FISA filings.

Third, court ordered the DOJ to “advise whether the conduct” of Clinesmith has been “referred to the appropriate bar associations for investigation or possible disciplinary action.”

"The FBI's handling of the Carter Page applications, as portrayed in the [Office of Inspector General] report, was antithetical to the heightened duty of candor described above," presiding Foreign Intelligence Surveillance Court Judge Rosemary Collyer said in an order released Tuesday by the court.

Collyer said the sheer number of FISA process abuses by the bureau during their investigation into Page made her wonder if the problem was widespread throughout the FBI's hundreds of other FISA investigations.

"The frequency with which representations by FBI personnel turned out to be unsupported or contradicted by information in their possession, and with which they withheld information detrimental to their case, calls into question whether information contained in other FBI applications is reliable," the FISA judge said.

"The [Foreign Intelligence Surveillance Court] expects the government to provide complete and accurate information in every filing with the Court.

Without it, the [Foreign Intelligence Surveillance Court] cannot properly ensure that the government conducts electronic surveillance for foreign intelligence purposes only when there is a sufficient factual basis."

Horowitz also harshly criticized top DOJ official Bruce Ohr for continuing to meet with Steele even after the bureau had cut the former MI6 agent off as a confidential human source for leaking to the media, acting as a conduit and backdoor between Steele and the FBI in 2016 and 2017.

The DOJ watchdog is also believed to have criminally referred one FBI lawyer, Kevin Clinesmith, who has since left the bureau, for altering an email used by officials as they prepared an application renewal to present before the Foreign Intelligence Surveillance Court.

Horowitz also slapped down former FBI Director James Comey's claim that he'd been "vindicated" by the DOJ watchdog's report when the watchdog testified before the Senate last week.

Clinesmith worked under FBI General Counsel James Baker and Deputy General Counsel Trisha Anderson.

He also worked on the Hillary Clinton email investigation and the Trump-Russia investigation, even working on special counsel Robert Mueller’s team for a time.

In the July 2018 IG Report, Clinesmith was criticized at least 56 times as being one of the FBI officials who appeared to convey a bias against Trump in instant messages, along with Peter Strzok and FBI lawyer Lisa Page, both of whom have left the bureau.

Former FBI general counsel James Baker said Monday that he felt “distressed” after reading the Justice Department inspector general’s report laying out “significant” errors and omissions in the bureau’s applications to surveil former Trump campaign aide Carter Page.

Baker’s remarks are in stark contrast to his comments earlier this year about the FBI’s handling of the Steele dossier and the FISA applications.


Back in May, Baker insisted that the FISA applications were “sufficient” to show probable cause that Page was a Russian agent.

He also said that it was “preposterous” to claim that the FBI would not have verified the Steele dossier.

“You don’t just swallow it hook, line and sinker.

That’s not what we do.

That’s preposterous.

That does not happen,” said Baker, adding that the FBI “spent a lot of time” trying to vet information in the dossier.

Probably just sacrifice 2 or 3 mid level people. Doubt they touch Comey. Also these FISA Court directives have a smell of CYA on them. My opinion--FISA judges were in on the scam.

Not sure who is worse, the ring leader of the crime scheme or the one that actually performs the dirty work.

Politicians are using these 3rd party conspirators to do the dirty work in what is manipulated to make it appear legal.

Lawyers - foundations - businesses, whatever mechanism that keeps a barrier between the ring leaders and the crime, always structured to look legally legit.

Such barriers can be hard to penetrate. DOJ & Courts can if they choose to, and that is what happening here, with an unknown outcome on how messy or far this goes.
