That's nothing. Went to the Kroger's next door to our Walmart, and one of the guys that works there, counting people into the store, stands beside the front entrance, calmly spitting on the sidewalk next to the door. Lotta spittle on the ground.

You can't arrest someone (nor should someone be arrested just for cussing).
That's a clear violation of the 1st amendment and you must be a communist against free speech to even suggest someone be attested for cussing.

Now he could definitely be thrown out of the store. Their store their rules. And from the sound of it he should have kicked him out of the store.
Then if he refused to leave they could call the police, have him trespassed, and if he still refused to leave, or came back then he could be arrested for trespassing.
But to arrest someone for cussing is a violation of the 1st amendment and totally communist.

Now I totally agree with this.
Arresting someone for cussing, even if they're being a total asshole is unconstitutional.
However businesses do have every right to kick people out and/or trespass them for cussing or being verbally abusive.

There was a very large woman the other morning going ballistic over the fact that they didn't have enough CDs of black musicians, or something like that, waiving the CD, screaming she's sick and tired of all the racism.

She knew she was acting as nuts as possible, even said, go ahead take me to jail, but the Walmart clerks acted like it was no big deal. Personally, I thought she was going to start breaking things, I would have called the po-po on this one.
