Biden will not be the candidate, so who and how will they replace him?

There is no functional FEC at this time because Congress will not confirm new members nominated by President Trump...

Each member serves a six-year term, and two seats are subject to appointment every two years.[6] Commissioners can, however, serve after their terms expire if they are not replaced.[5] By law, no more than three commissioners can be members of the same political party, and at least four votes are required for any official commission action.

Following Matthew Petersen's resignation on August 31, 2019, the commission has had only three members, and is unable to conduct most of its regulatory and decision-making functions.
