The First Amendment which ratified in 1791 states that "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof." However, the phrase "separation of church and state" itself does not appear in the United States Constitution.If there is "no law" then any government interference violates the constitution. Enforcement of a non-law for public safety may be in the public interest but it should be viewed as the violation it is and those who issue such an order to be carried out must be accountable to the judicial system to show just cause and obtain pardon.
