Does Civil War Suspend Posse Comitatus?

After you've declaired a national emergency, you can declare martial law. This suspends the constitution, which removes PC. The the legislature can basically file a complaint and it goes to the supreme court.

The point here is that there is a procesx of notifying people, and being subject to review. But you could get a good week or two in before the process ran its course.

Then its either martial law for the duration or impeachment, trial and punishment. So you want to get it right.
