President Donald Trump announced Monday he's considering invoking the Insurrection Act, What is the Insurrection Act of 1807?
As protests continue across the United States following the death of George Floyd, an African-American man killed by a Minnesota police officer, President Donald Trump announced Monday he's considering invoking the Insurrection Act, which involves deploying active military members to American streets.

“I am mobilizing all federal and local resources, civilian and military, to protect the rights of law abiding Americans,” Trump said in an address at the Rose Garden Monday afternoon."If a city or state refuses to take the actions necessary to defend the life and property of their residents, then I will deploy the United States military and quickly solve the problem for them."

Twitter immediately began to question the decision. Does the president have the legal authority to do something like that?

It turns out that he does. Trump could reach back to the 1807 Insurrection Act, which gives the president the power to send military members to the streets of cities during protests. The act was signed into law by Thomas Jefferson and was last invoked in 1992 during the Rodney King riots, according to NBC.

There is some belief that the 1878 Posse Comitatus Act dictates the government cannot use active military as an active police force within U.S. borders, but its power in this circumstance is disputed. Dan Lamothe, who covers the military for the Washington Post, says "the president can use active-duty forces on American soil, especially in Washington," and that "the Posse Comitatus Act does not prevent it."

The Insurrection Act, specifically, contains several sections, but the first two are the most relevant. The first involves federal "aid" for state governments. It states at the request of a governor (or a state legislature if the governor is unavailable), the president can send "land or naval forces of the U.S." ... "to suppress [an] insurrection" or rebellion.

I like Trump but theirs no time to waste thinking about things or waiting to see if it prompts governors to be more proactive, this is one of those moments where hard decisions need to be made and fast to stop it in it's tracks. The longer he leaves it the harder it will get and the worse it will be for him to recover from coc the msm n social media can smell blood.

I disagree. The military should start rounding up these commie rioters and hold them in closed military bases to later be tried by the military for treason, the penalty which is death. That would put a stop to this crap once and for all.

To see conservatives support militarized police and military enforcing domestic laws is very scary. We were the last people to really care about that kind of thing with don't tread on me being the motto.

We have a week of unrest and all of a sudden because of celebrity worship of Trump we just throw out all of our strongly held beliefs in posse comitatus and support the stepping stones of tyranny. A terrifyingly short sighted move if I've ever seen one. Anything you support this President doing will assure it's used against you by future Presidents.

To see conservatives support militarized police and military enforcing domestic laws is very scary. We were the last people to really care about that kind of thing with don't tread on me being the motto.
