Of course, they had him in the back seat once but he kept fighting. He was probably hiding drugs and the cop felt them and was trying to retrieve them. Then they sat on him too long. Not murder.

Trial: put expert witness in the same position. Maintain pressure for 9 minutes. Witness lives, cop goes free. Witness dies, cop gets convicted.

No. The district attorney decides what the defendant will be charged with, and that is what crimes they will be found guilty or not guilty in a trial.

Often times it is a tactic to charge them with a more serious crime, but offer a plea bargain for a less serious crime to avoid trial.

I doubt that is what will happen in this case, though.

Also, if they try them for murder, and they are found not guilty the defendant can not be retried for the same crime, even with lesser charges such as negligent homicide, or manslaughter.

I agree with everything you say -- refusing to even click on any Politico link -- except none of these officers are getting off. Period. They will be tried by an unfair jury in an unfair courtroom by an unfair prosecutor.

I'm not sure about the law in Minnesota but in most states the jury will get an instruction that if they fail to find the required "intent," they can still convict on what's called a "lesser included charge."

I can absolutely guarantee these officers will never be found not guilty in the kangaroo court they are facing.

I'm not saying that they should walk free but I am saying that the law should be the same for everyone . . . and if blacks don't like a racist court where they are railroaded, then they shouldn't celebrate it when they are doing the railroading.

If Minnesota picks a black judge and mostly black jury for this case along with Ellison, that would be an obvious case of "fixing" the courtroom. Those cops are going to beat this murder charge one way or the other. It was not murder but as I said, Ellison is an idiot.
