Court-appointed former Judge Gleeson accuses Flynn of perjury, DoJ of "gross abuse of prosecutorial power", urges court to NOT drop charges
A former judge appointed to argue against the Department of Justice's (DOJ) extraordinary decision to drop charges against Michael Flynn urged a federal judge not to let the Trump administration withdraw its case and accused the former national security adviser of perjury.

In a 82-page filing submitted Wednesday, John Gleeson, the former judge acting as an outside counsel, accused the DOJ of "gross abuse of prosecutorial power" in its handling of the case against President Trump's former adviser.

"The Government’s ostensible grounds for seeking dismissal are conclusively disproven by its own briefs filed earlier in this very proceeding," Gleeson wrote. "They contradict and ignore this Court’s prior orders, which constitute law of the case. They are riddled with inexplicable and elementary errors of law and fact. And they depart from positions that the Government has taken in other cases."

"The Government has engaged in highly irregular conduct to benefit a political ally of the President," he added.

He also accused Flynn of committing perjury in withdrawing from an earlier guilty plea, but recommended the court not to open criminal charges.

"The reasons offered by the Government are so irregular, and so obviously pretextual, that they are deficient," he wrote. "Moreover, the facts surrounding the filing of the Government’s motion constitute clear evidence of gross prosecutorial abuse. They reveal an unconvincing effort to disguise as legitimate a decision to dismiss that is based solely on the fact that Flynn is a political ally of President Trump."

Re: Court-appointed former Judge Gleeson accuses Flynn of perjury, DoJ of "gross abuse of prosecutorial power", urges court to NOT drop charges
"The Government has engaged in highly irregular conduct to benefit a political ally of the President. The facts of this case overcome the presumption of regularity," Gleeson wrote. "The Court should therefore deny the Government's motion to dismiss, adjudicate any remaining motions, and then sentence the Defendant."

"As the D.C. Circuit has made clear, that deference is not blind and this Court is not a 'rubber stamp,'" Gleeson wrote. "Where the Government engages in corrupt, irregular conduct that threatens the legitimate interests of the Judiciary, it has no right to leave of court under [the rule]."

Gleeson said Flynn "chose to lie about [the calls] — just as he had lied to various senior White House officials."

"That is about as straightforward a case of materiality as a prosecutor, court, or jury will ever see," Gleeson wrote. "In asserting otherwise, the Government struggles mightily to argue that Flynn's false statements neither affected nor could have affected the FBI's investigation of his and his colleagues' potential ties to the Russian government."

Looks pretty clear to me that the court will not accept DoJ's request to drop the charges and Flynn will proceed to sentencing.

I see you know nothing about the law.

Judges are suppose to be impartial and honest. Sullivan has openly called Flynn a traitor in open court and has refused to force the prosecution team to turn over Brady information that was withheld for 3 years. It proves the FBI, The Special Counsel under Mueller, Pelosi, Schumer, Schaffer, Nader, Booker, Harris, and dozens more were involved in a soft coup.

This is why Sullivan is dragging this out and refusing to listen to The DC Court. He is aiding the coup attempt by putting a gag order on Flynn so he can’t divulge what illegal activities occurred under the Obama regime.

“The rule empowers courts to protect the integrity of their own proceedings from prosecutors who undertake corrupt, politically motivated dismissals . . . That is what happened here.”

Exactly.

hesright

...unless Judge Sullivan totally rejects all of Judge Gleeson’s findings, which is obviously unlikely. It will take Judge Sullivan a couple of weeks to draft his decision and that’s it.

In other words Obama’s RAINBOW GESTAPO is pulling the strings on this judge to condition the public into submission by making an example out of GENERAL FLYNN as a warning to the public that they can do this to anybody
