Master Fact Checker User ID: 70971451 Finland 07/02/2020 06:24 AM Report Abusive Post Report Copyright Violation | How can a picture, of yourself, be a copyright violation? Q-tards have been using that meme forever. Fuck the NYT's. "we took the photo, it is ours" bunch of Karens and like that bitch from Havard who claimed anyone saying 'all lives matter will be knifed'...they will soon be fired. See above The meme used a copyrighted picture taken by Damon Winter, a Pulitzer-Prize winning photographer for The New York Times. The photo was taken by The Times to accompany a feature it wrote on then candidate Donald Trump in 2015. The right of publicity, sometimes referred to as personality rights, is the right of an individual to control the commercial use of one's identity, such as name, image, likeness, or other unequivocal identifiers. It is generally considered a property right as opposed to a personal right, and as such, the validity of the right of publicity can survive the death of the individual (to varying degrees depending on the jurisdiction). [link to en.wikipedia.org (secure)] Well that was easy. NEXT! I saw the younger Gretzky's go through this BS. photograph copyright is not the same as the right to your likeness ... the meme needs just a different photo and it's ok, I'd say this is petty legal trolling from NYT but it's by the book. re:Gretsky, with some sports video games athletes sell exclusive rights to their likeness preventing them to sell their likeness for other games, it's strange, but it is what it is. |

It what it is I guess! I have one of 50 posters with Wayne and Gordie Howe and they made a point of signing them to a person (to: Lance) so as to make the resale value less. SO ya, I can see it maybe being an issue...I'll dig a bit more. Master Fact Checker User ID: 70971451 Finland 07/02/2020 07:36 AM Report Abusive Post Report Copyright Violation | copryright law cases are often strange and counter intuitive ... CCR's John Fogerty was sued for plagiarizing himself ... he didn't own the rights to the songs he had written for CCR and when he recorded as a solo artist a tune similar to a certain CCR song he had to pay ... I think he lost the case ... Tom Waits sued a company, not for using his music without permission but because in their ad they had a guy singing who sounded like Tom Waits ... Miles Davis published an autobiography, basically he was just reminiscing aloud to his editor, and as his memory was occasionally vague, he refreshed his recollection reading a biography written by another guy ... This author, Ian Carr, if memory serves sued for plagiarism ... and then in the world of high art, there was a female photographer who took photographs of old famous photographs ... instead of getting sued she was extolled as genius for "interrogating" and "deconstructing" notions of authorship etc. -- the idea of selling your likeness is spooky, almost diabolic, and even having you photograph taken is or was taboo for various native tribes and individuals anyway Trump own his own likeness and he can strike the same pose insaide the OVAl Office, wearing same clothes and have more or less the same pic taken again and there's nothing NYT can do about it. |

John Fogerty won the self plagiarizing lawsuit after all not because getting accused of plagiarizing yourself was absurd but because the songs were deemed different enough Fogerty v. Fantasy, Inc.
