Benitez’s ruling against California’s ban on standard capacity magazines. Obviously, that is a very important development. But the panel didn’t merely uphold that; the panel upheld Benitez’s position that potential Second Amendment infringements must face strict scrutiny. Proceeding to prong two of the inquiry, the panel held that strict scrutiny was the appropriate standard to apply. Nearly every violence-enabling victim-disarmament gun control law on the books has stood because courts almost invariably apply intermediate scrutiny, a made-up test that allows the Constitution to be violated if the government claims some equally imaginary “interest” served by continuing to screw the people. Right on! I am positively sick to death of all the anti-second amendment legislation. There are far too many laws on the books already. How about using what we have to prosecute criminals? There is no need for more unless the goal is total disarmament(That's rhetorical. I know that is the end game.). These crooked politicians try to confuse/obfuscate/use "the letter of" or "the spirit of" the law to their advantage in every scenario. They cannot have both. We cannot allow them to pick and choose the best answer to screw We the People any longer. If there is one thing I have personally learned and truth be told I've always known. Here in chicongo with all this unrest is that the only thing keeping me and mine safe is my God given right to self defense. I am a law abiding citizen. There are far too many laws and restrictions placed on my ability to defend myself, my loved ones and my property. I have had enough. This is one of my few lines in the sand. If Beccera appeals for an en banc review and they lose, ALL GUN CONTROL LAWS IN THE ENTIRE REGION that were upheld using "intermediate scrutiny" could be overturned. The 9th circuit is now 16 to 13 commie vs. American, and the en banc panel consists of 10 RANDOMLY SELECTED judges. The odds are pretty good that you'll get a conservative panel and a ruling that applies "strict scrutiny" to 2nd Amendment related laws, thereby paving the way for ALL recent restrictions being repealed throughout the entire Far West. If Beccera appeals for an en banc review and they lose, ALL GUN CONTROL LAWS IN THE ENTIRE REGION that were upheld using "intermediate scrutiny" could be overturned. The 9th circuit is now 16 to 13 commie vs. American, and the en banc panel consists of 10 RANDOMLY SELECTED judges. The odds are pretty good that you'll get a conservative panel and a ruling that applies "strict scrutiny" to 2nd Amendment related laws, thereby paving the way for ALL recent restrictions being repealed throughout the entire Far West. That wormy little bitch AG Beccera must be crapping himself right now, and I love it. FYI it's still not legal to buy mags over 10 rounds. Benitez's initial stay is still in place, so he either has to remove it or the three judge panel has to issue a ruling to remove it. Also California will surely appeal this to an en banc panel. After watching the bikers in Sturgis and the Antifa goons beings lead out of town it doesn't take a rocket scientist to realize the middle of America is fed up with the left quashing the God given rights of free speech and gun ownership for self defense. The bikers gave America a glimpse of what is in store if the Left has its wishes and bans guns. Americans are tired of putting on masks. They are tired of the left always getting their way. They are tired of mountains of national debt and most of the debt going to leftist causes. Like the bikers, Americans will begin targeting leftists if the lid ever pops off the cooker. Once the carnage begins it will not end for a very long time.
