He is. He is supposed to be discharged today. The eviction is necessary by law, as Matthew is an established resident of my brother's house, even though he has never contributed anything to the household, nor has paid any rent.
The restraining order is for Kenny's protection. Even though Matthew is going to stay with the Aunt, he is still fairly close to Kenny's house, definitely within walking distance. With the restraining order, if Matthew shows up at Kenny's house, he will be immediately arrested.

Matthew Update

He got out of the psych ward today.He did come over with his Aunt to grab some of his things.Kenny has to go back to his lawyer tomorrow to finish up the paperwork for the restraining order, and the eviction. There is a moratorium on evictions from now until January 9th, because of the holidays. The eviction can be posted, but it will not be enforced until January 9th.
A restraining order isn't easy to get. Kenny has to list all the threats, physical assaults, and the damage to his house, as a reason to get the restraining order.
It turns out that Matthew will only be able to stay at his Aunts for a week or 2, then he has to find somewhere else to live. He is definitely never going to live at Kenny's again.

Thank you for the prayers ! Matthew has repeatedly called Kenny, but Kenny refuses to take any of Matthews calls.

Kenny can't get a restraining order. There isn't enough physical altercations to prove a threat. I guess smashing a TV on the floor in front of him, punching holes in walls and doors, and hitting him with a remote isn't enough. So, Matthew gets a pass.

Kenny did get the eviction notice served on Matthew. He has until January 1st to move out, but with the county moratorium on evictions for the holidays, he has until January 9th. But the worse thing is, Matthew, as an established resident at Kenny's home, has a right to live there until that time. Matthew is moving back in on Monday, as his Aunt is kicking him out on that day.

IMO, if I was Kenny, I would say the heck with the laws that are protecting a criminal. I would not let Matthew back in the house, in defiance of the unjust law. Safety for Kenny, who is 76 years old, and had a lot of his guts removed from cancer surgery, is more important than 28 year old Matthews "rights".

My middle daughter Elizabeth called me this morning. Her furnace went kaput last night.The furnace company came over today. Her furnace is 47 years old, and no parts are available to fix it. She has to get a new furnace, which is going to cost her $5,000. Elizabeth has 4 kids, ages 4 to 13.
No Merry Christmas this year for Elizabeth or Kenny. :(

My car is still in the shop. The past couple of months, I have only had my car for about a week total. I am not happy.
