Most likely the issue is the "brandishing"
Depending on the wording of the castle laws in Minnesota he might have done better to just shoot.
In TX I'm fairly certain that deadly force can be justified if they're on your property (it's no longer that they have to be in the house) and if it's night time it doesn't matter where in the body you shoot them.
However there is no such thing as a warning shot (illegal) & brandishing is only allowed under limited circumstances and never as a threat & only if imminent bodily harm is reasonably expected (if I remember correctly...not a lawyer...don't use this as legal advice).

Very surprised that the police didn't do anything to clear the street or serve tickets for disorderly conduct & noise violations.
