Most likely the issue is the "brandishing" Depending on the wording of the castle laws in Minnesota he might have done better to just shoot.
In TX I'm fairly certain that deadly force can be justified if they're on your property (it's no longer that they have to be in the house) and if it's night time it doesn't matter where in the body you shoot them.
However there is no such thing as a warning shot (illegal) & brandishing is only allowed under limited circumstances and never as a threat & only if imminent bodily harm is reasonably expected (if I remember correctly...not a lawyer...don't use this as legal advice).

Open carry in a holster would have the same effect. Coldkidc is correct, NO warning shots. If you feel that your, or other loved one's, life is in danger, then that is the only legitimate reason that you have to shoot someone. Of course, in some small rural areas, "he needed shooting" is sometimes accepted as a valid reason to kill someone.
