Wasn't the Republican Party trying to use that to say that giving special treatment to religious groups precludes the governor from issuing any lock down orders at all? Didn't the court find that religious liberty is expressly protected by the First Amendment, and that special care taken for religious groups did not preclude the governor from exercising emergency powers regarding other types of gatherings? Did the court not warn that special treatment for some groups, over others, could eventually rule the order null and void? Maybe the lawyers didn't make the right argument concerning the proper legal theories to get a ruling favorable to them with respect to ending these bullshit lockdowns, and the court didn't want to create stare decisis that would render needed action at a later time, for an actual crisis, impossible, based upon the wrong legal theory. |

Specifically, the request is to lift the restriction on limits of meetings to 50 people based on the fact that churches can have assemblies of more than 50 and rioters are not being arrested for violating the order. Those facts are alleged to violate the rights of IL GOP members guaranteed by the 14A. Request was unanimously rejected by the Appeals court because (1) selective enforcement is not a valid ground for a challenge because the rioters should be arrested (2) Religious institutions typically have the widest latitude of protections of the Constitution. The assertion that the IL GOP is not being treated as other like entities is therefor invalid, and the petitioner is therefore unlikely to be able to make a valid claim, which is a requirement for granting an injunction." And the IL GOP appealed to SCOTUS as well, and were rejected by Kavanaugh (Trump appointment). The IL GOP needs a better attorney should be the lesson learned here. However, she appears to be solid on gun rights judging by her dissent in Kanter v Barr (gun rights for non violent felons case) arguing that the gun rights of non-violent felons should be restored. But thank you for reminding us that the people being being looked at to replace RBG are imperfect people. Maybe Trump should just give up trying to replace her, pull her nomination, and just wait till the Democrats steal the election. Then let them go ahead and replace her with some democrat pick, always works better. |
