I don't know how many of you remember the disappearance and murder of 20 year old Mollie Tibbetts, but the man who has been charged with her murder, Cristhian Bahena Rivera, will finally have his day in court on January 26, 2021.

Who is Cristhian Bahena Rivera, and why was he charged with Mollie's murder?

Well, he's an illegal immigrant from Mexico. Who admitted to killing her. Who led investigators to the desolate cornfield where he hastily covered her body with straw. And gave police permission to search the trunk of his car, where her hair and blood were found.

He (allegedly) stabbed her multiple times in the chest and skull, placed her in the trunk of his car, drove to 460th Avenue in rural Poweshiek County, Iowa, then went back home.

When investigators asked him why he did all this, he said he became upset when, after following her in his car when she was out running in her hometown, she spurned his advances.

He said he then "blocked [his] memory", because he was so furious at being turned down by the girl. Then he killed her, and dumped her body in a cornfield.

His defense team tried to argue that his confession should be thrown out, because he was an illegal Mexican and didn't understand his Miranda rights; and that even if he understood them, they weren't properly given; and that even if they were properly given, he should have contacted a lawyer.

Judge Joel Yates ruled that some of the confession would not be admissible in court, but largely agreed with the state, ruling that:

"Bahena Rivera did consent to the search of his car, that his statements were made voluntarily despite his claims of sleep-deprivation and lengthy interrogation and that law enforcement did not use language likely to induce a false confession," court records show.

So. Where does that leave us?

With a trial set to begin at the end of January 2021, roughly three months from today.

Any opinions or comments are welcome, especially if they have a legal perspective or the poster has a background in criminal law.

Of course in America, all defendants are considered innocent until proven guilty beyond a reasonable doubt, in a court of law.

But on a personal level, I hope this "man" -- who admitted to killing her -- will not walk free when this trial is over. I pray to God that the prosecution makes a strong case and that the good people of Iowa will find it in their hearts to uphold the good name and honor the brief, beautiful life of Mollie Tibbetts.
