Courts can't toss ballots, but they can rule if the election was constitutionally done or not or if they believe it was fraudulent. If SC rules election was fraudulent or uncostitutional, they will simply say there is a remedy for that in the constitution, which there is. But even that remedy may need to be ruled upon because now the question is, if some states don't send electors, do candidates still have to reach 270 or it goes to the house delegations, or is it simply which ever candidate has the majority of remaining electors? That seems to be the new question being posed. It seems to me that if it was as simple as whichever candidate has the majority of electors, why even have a remedy of giving each state house a single vote? |
