CALIFORNIA’S ELECTORAL COLLEGE DELEGATES MAY BE INVALID.
SUMMARY: California law states that if voter’s ballots are missing paragraph(s), they CANNOT BE CAST OR COUNTED. This because ballots are missing a legal paragraph(s) as required by new California law.

California violated its own election laws

[Excerpts] In California state law, the election code is titled “Division 13. BALLOTS, SAMPLE BALLOTS, AND VOTER PAMPHLETS.”
In Article 1 of this code we find Election Code 13200, which reads as follows:
“Ballots not printed in accordance with the chapter [Chapter 3] shall not be cast nor counted at any election.”
That’s straightforward English. It’s at the 9th grade reading level, so assuming California’s election officials can understand it, her it is one more time, with emphasis:
“Ballots not printed in accordance with the chapter [Chapter 3] shall not be cast nor counted at any election.”
When we read a little further, we find Section 13205. Since we’re talking about the election of the President and Vice President, we’ll look at the applicable subsection:
13205 (b). In elections when electors of President and Vice President of the United States are to be chosen, there shall be placed upon the ballot, in addition to the instructions to voters as provided in this chapter, an instruction as follows:
“To vote for all of the electors of a party, mark the voting target next to the names of the presidential and vice presidential candidates of that party. A mark of the voting target next to the name of a party and its presidential and vice presidential candidate, is a vote for all of the electors of that party, but for no other candidates.”

This Napa County ballot is missing required text from Section 13205 (b). California code 13244 states sample ballots must match actual ballots, including instructions.
In other words, by California law, the paragraph quoted was supposed to appear on all California ballots. And remember, according to Section 13200, “Ballots not printed in accordance with the chapter [Chapter 3] shall not be cast nor counted at any election.”
And guess what? According to data collected by the American Independent Party in California, those words did not appear on ballots in 53 of California’s 58 counties.
In the remaining five counties, ballots required additional wording that is outlined in California Election Code 12305 (c) [Typo: 13205 (c)]. Some of those county’s ballots included the wording from section (b), but ballots in all five of those counties were still missing the required wording from section (c).

(b) In elections when electors of President and Vice President of the United States are to be chosen, there shall be placed upon the ballot, in addition to the instructions to voters as provided in this chapter, an instruction as follows:
“To vote for all of the electors of a party, mark the voting target next to the names of the presidential and vice presidential candidates of that party. A mark of the voting target next to the name of a party and its presidential and vice presidential candidate, is a vote for all of the electors of that party, but for no other candidates.”
(c) If a group of candidates for electors has been nominated under Chapter 3 (commencing with Section 8400) of Division 8, and has under Chapter 1 (commencing at Section 8300) of Division 8 designated the names of the candidates for President and Vice President of the United States for whom those candidates have pledged themselves to vote, the instructions to voters shall also contain the following:
“To vote for those electors who have pledged themselves to vote for a candidate for President and Vice President not supported by any particular party mark the voting target next to the names of those presidential and vice presidential candidates.”
(d) If a group of candidates for electors has been nominated by a party not qualified to participate in the election, the instructions to voters shall also contain the following:
“To vote for those electors who have pledged themselves to vote for a candidate for President and for Vice President of any party not qualified to participate in the election write in the names and party of those presidential and vice presidential candidates in the blank space provided for that purpose.”

DFS COMMENTS: On election day (11/03/2020), I took a digital photo of my ballot here in Siskiyou County, California. I examined the photo, and it contained the paragraphs required in §§13206(a)(1) “PARTY NOMINATED OFFICES” & (a)(2) “VOTER-NOMINATED AND NONPARTISAN OFFICES”. It DID NOT contain the paragraphs of §§13205(b), (c), or (d).
The document “VOTING INSTRUCTIONS FOR VOTING BY MAIL – Please read BEFORE voting” did not contain the paragraphs of §13205(b), (c), or (d). The Sample Ballot did not contain the paragraphs of §13205(b), (c), or (d).
This new law, requiring the text of §§13205(b), (c), and/or (d) was from AB623 and took effect on January 1st, 2020. The California legislature is in strong control by the Democrats.
