Anyone who casually walked through the Capitol and did nothing destructive or threatening probably should be protected from all but the most minimum charges - trespassing. On film, it looks like there were a number in this category.

And, it's possible some people in the Capitol just inside the doorways and who went no further in had not intention of entry but were pushed in by the mass of people outside. I saw some of that happen on film.
