this is date they wrote it. if you recall they held it back from filing it till Biden was in and Trump was out. So late on the 20th or some time after that date they filed it.
So Trump was no longer Pres. So filing it at date they did they can not go threw with it by law. Now only way they can do this is if he is still Pres., so they have to come out and state he is still the setting Pres. and then they can impeach him. i am no lawyer but this is how i read the law on this.

An impeachment is the REMOVAL from office. He has not been removed neither once nor twice. He cannot even be removed the first time from an office he no longer holds..... unless He is still the President

If they filed paper work before the 20th then, even out of office they can do this but as they filed paper work after the he is out of office, now they can not .

This was/is an idea that skipped many minds somehow in the beginning. But, many went with the 'capitol storming' emotion or the Pelosi laptop stealing.

Impeachment is only to remove formally a sitting president out of office. If not than it is all about a citizen and that is a total different ballgame. One could see this strange happening from far away.

It surprises only that few are picking this up.
