Good first steps by Texas and Florida, but I don't this restricts the real problem. The real problem is the mega corporations everyone has been bottle necked into that will require them. The dream is that not enough people take the vaccine and it hurts the bottom line. Starve the beast as hard as it may seem.

Well, this order goes pretty far. It states that any corporation that receives public funds or benefits may not enforce this passport.

I'm guessing that's alot of these big corporations as most of them are subsidized in one way or another.

Brilliant tactic. Evil, but brilliant. Manufacture an emergency to justify giving special priveleges to chosen corporations (Amazon, Walmart, Costco, etc) so that the little guys get stamped out, on the condition that the chosen corporations implement authoritarian policies that the government could never get away with.

Can't stop private companies from implementing the policies, because muh free market.

Can't allow small competition to emerge to serve the market share that would go somewhere else, because muh pandemic.

The government could easily 'stop' commercial trade or requirements of any kind. The issue is, the several States ceded their right to 'regulate commerce' via the commerce clause of the US constitution. Therefore any company that engages in interstate commerce (which is every company) is now under Federal regulation and not State.

The federal government regulates everything, there is no 'muh free market'. Try working in any industry and not following some arbitrary administrative federal procedure and see how long until a federal alphabet agency shuts you down.

What States do have control of, is implementing laws when corporations accept benefits from THEIR STATE. Therefore if the company receives some benefit for doing business in that State in the form of tax benefit, public service, pecuniary aid, or otherwise, they have now contracted with THAT STATE to abide by it's rules. Now the several State's contract supercedes the federal one as long as it doesn't contradict with it.

The problem isn't 'muh free market' - it's Federal government regulation of 'market' via plutocracy. Our 'federal government' is a literal revolving door in which corporate CEO's, Admins, and Shareholders move from Corporation to Political Office like musical chairs. These 'politicians' (read: Corporate shills) accept past, present, or future benefits from the corporation to influence public policy.
THAT IS FASCISM. There is no serious protection or law that prevents these people from accepting future jobs or benefits in corporations. Every member of congress goes in piss broke and comes out a multi millionaire. THAT IS PLUTOCRATIC FASCISM.

Free Markets are not fascism. We don't have 'free market', we have government controlled market. Until society chooses to actually hang their 'leaders' that accept benefits from corporations for the purpose of influencing policy, this will go on forever.

Socialism is the same thing, so I hope that's not what you're implying as an alternative. It's the merger of State with Corporation, only this this the State LARPS as if the corporation doesn't exist, while the State becomes the corporation and the State officers no longer have to pretend they have the revolving door.
