Don't know if this has been brought up but it appears the defense attorney is setting the stage for the amount of drugs in his bloodstream. He had those pills in his mouth a long time. Which means he was delivering them sublingually into his body. If he had swallowed them his stomach acids would have given him some protection.

Think nitroglycerin / heart attack.
